Safety: Our highest priority is your safety. We are well qualified to lead all aspects of your adventure. We have an excellent safety record. In all guided whitewater rafting, caving and rock climbing or outdoor adventure programming involving travel in remote areas and the unpredictable forces of nature, there will be inherent risk of injury, death or other losses. We seek to minimize risk through extensive preparation, staff training, use of high-quality equipment, and safety policies and procedures. We also provide the supervision, instruction, and equipment needed to minimize risk while participating in outdoor adventure activities. But in the end it is impossible to remove the inherent risks from adventure activities.

Liability: Although we do everything we can to insure a safe and enjoyable trip, because of the inherent risks involved and nature of outdoor adventure activities, we will not be responsible for personal injuries or loss of or damage to personal property. Participation is at your own risk. Mountain Adventure Guides dba USA Raft French Broad, Nolichucky and Watauga Rivers assume no liability or responsibility whatsoever for personal injuries, damages, or losses to persons or loss of personal property or belongings. We require that all participants acknowledge the inherent risk of injury or other losses by signing an assumption of risk and waiver of liability form before your trip. Anyone not 18 will have to be signed for by a parent or legal guardian. A copy of the form is below for your review.

Choosing the right trip for you and every member of your group:  Evaluate your personal health, fitness and age to select the most appropriate trip for you and every member of your group. For your safety, we request that pregnant women not participate in our trips. Anyone found to be impaired by alcohol or illegal drugs will be excluded from our trips. Notify us in advance of physical or mental disabilities and seek professional medical advice if you question your health or fitness for the trip. Please keep in mind that because of the nature of our trips in outdoor wilderness settings, emergency medical help will not be immediately at hand or available quickly if needed. MAG reserves the absolute right, in our sole discretion, to refuse to allow you or any member of your group to take part in any activity.

Your Responsibility:  MAG dba USA Raft French Broad, Nolichucky and Watauga Rivers provides instruction and outfitting for each trip. It is your responsibility to follow these instructions. Participation in climbing, caving, whitewater rafting and all outdoor adventure sports is physically demanding. Please bring any medications that you or anyone in your group may need for the duration of your trip. Your physical condition may pose risks to your health and well-being while taking part in climbing, caving, whitewater rafting and guided activities. Specifically, you must acknowledge that medical conditions like, but not limited to, a heart condition, hypertension, diabetes, poor eyesight, back problems, arthritis, allergic reactions, asthma, joint problems and any other medical condition that might limit your physical stamina could pose risks to your health when participating in outdoor adventure activities. You alone are responsible for determining whether you and everyone in your group is fit enough to engage in the activities. MAG and the other Released Parties accept no responsibility for injuries, conditions or deaths caused by your physical condition. MAG and the other Released Parties reserve the absolute right, in their sole discretion, to refuse to allow you to take part in any activity.

PARTICIPANT RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT
Please read carefully.
In consideration of being allowed to participate in any way in the Mountain Adventure Guides LLC
dba 1-866-USA RAFT program, its related events and activities, I, ________________________________,
the undersigned, acknowledge, appreciate, and agree that:
1. The risk of injury from the activities involved in this program is significant, including the potential for
permanent paralysis and death, and while particular skills, equipment and personal discipline may reduce
the risk, the risk of serious injury does exist; and,
2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF
ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my
participation; and
3. I willingly agree to comply with the stated and customary terms and conditions for participation. If,
however, I observe any unusual significant hazard during my presence or participation, I will remove myself
from participation and bring such to the attention of the Company immediately; and
4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY
RELEASE, INDEMNIFY, AND HOLD HARMLESS Mountain Adventure Guides LLC dba 1-866-USA-RAFT,
their officers, officials, members, agents and/or employees, other participants, sponsoring agencies,
sponsors, advertisers, and, if applicable, owners and lessors of the premises used for the activity
(“Releasees”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to
person or property associated with my presence or participation, WHETHER ARISING FORM THE
NEGLIGENCE OF THE RELEASEE OR OTHERWISE to the fullest extent permitted by law.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY
UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY
SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
Finally, I hereby irrevocably consent to authorize Mountain Adventure Guides LLC dba 1-866-USARAFT
to use and reproduce any and all photographs and videos taken of me for any purpose whatsoever,
without further compensation to me. All such photographs and videos, including negatives and the like are
solely the property of Mountain Adventure Guides LLC dba 1-866-USA-RAFT.
